2003 Law Strategies – From Date of Accident to PTD, What Not to Do and Why

Educational Objective: Students will learn how the October 1, 2003 law changes have dramatically impacted the need to anticipate and respond to new scenarios from injured employees, physicians and the claimant’s bar? due to the new statutory requirements. They will be provided with new insights on the techniques and requirements under 440.491 to assist injured workers in finding viable employment options to defend or mitigate permanent total disability claims, limit temporary partial exposure and resolve extended disability claims.
They will learn the difference between vocational evaluations, reemployment assessments, labor market surveys and transferable skills analysis, and when each is appropriate to use and at what stage in the claim for maximum effectiveness. Finally, real-life claim scenarios will be presented to help adjusters relate these strategies to their own claims and provide insight on how to address the challenges they are currently facing.
