Todd Loomis, ReEmployAbility’s National Sales Manager & ReAudio: ReAssess Your Work Comp Toolbox host, sits down to speak with Shawn Deane, former General Counsel and Senior Vice President of Risk Management and Compliance at Ametros. They discussed Shawn’s professional path to becoming a workers’ compensation attorney and his dedication to providing compassionate care to injured workers. They also touch on the growing emphasis on the human aspect of workers’ compensation and the necessity of making industry changes to improve services for injured workers. Shawn shares his insights on the misconceptions surrounding workers’ comp and the significance of demonstrating dignity and respect towards injured individuals. The episode concludes with a conversation about the impact of storytelling; Deane, as former host of the “It’s Settled podcast,” shares his unique perspective on treating injured workers as individuals with unique stories and needs.

Shawn’s journey into the realm of workers’ compensation is a testament to the unpredictable paths that lead individuals to this industry. Born and raised in Southern California, Shawn initially pursued a music career, attending Berkeley College of Music with dreams of becoming a rock star. However, life took a different turn, leading him to education and law school.

Shawn’s introduction to workers’ compensation occurred serendipitously when he applied for a job in the wrong field. This inadvertent entry began his deep involvement in the Medicare secondary payer space, a niche within workers’ compensation. Over the years, Shawn’s passion for the industry grew, and he found himself uniquely positioned to contribute to the well-being of injured workers. With experience as a lawyer and general counsel for worker’s compensation claims, he evolved in his field to embrace a path of empathy.

Motivated to connect with people and bring their stories to light, Shawn launched the “It’s Settled” podcast during the pandemic. The podcast aims to delve into the humanity of workers’ compensation, showcasing the diverse narratives of injured individuals and industry professionals making a positive impact.

Shawn’s background as an attorney has not hardened him but, instead, has cultivated empathy toward injured workers. His dual role as a legal professional and an advocate for human-centered approaches positions him uniquely to bridge the gap between legalities and compassion.

Additionally, the podcast serves as a platform to humanize the workers’ compensation process. By sharing real stories of individuals navigating the complexities of work comp, It’s Settled contributes to breaking down stereotypes and fostering understanding. Deane elaborates on this: “I want to talk to injured individuals because I want to get their stories out. They each have their own unique story that I think deserves to be told.” Shawn shares anecdotes of impactful moments from his podcast, highlighting the resilience of injured individuals and the professionals dedicated to their well-being. These stories underscore the importance of treating each case with nuance and understanding.

Shawn acknowledges a positive shift in the industry’s perspective. The historical stigma surrounding workers’ compensation, often seen as a battleground between employers and claimants, is gradually giving way to a more balanced and human-centric outlook. “I think in general, we’re in the middle. And I hope, and it seems where the trend is going to take a more human approach and go, this is just someone who got hurt on the job,” Deane attested. Emphasizing the frame of reference that all work comp professionals should take when working with injured individuals and their claims.

Furthermore, the traditional adversarial nature of workers’ compensation is undergoing reevaluation. Initiatives to revise language, eliminate stigmas, and focus on individual-centric processes are shaping a more empathetic and effective industry. Deane hopes to continue to create that space by sharing stories and giving a voice to those injured workers. By doing this, he hopes we can begin to change the mindset of those in the industry.

While the shift towards a human-centered approach is evident, Shawn emphasizes the need for practical implementation. Beyond discussions, the industry must actively adopt processes prioritizing injured individuals’ dignity and respect. The future of workers’ compensation lies in redefining the perception of the industry. Consequently, the workers’ compensation landscape can evolve into a more compassionate and effective system by dismantling stereotypes, embracing empathy, and implementing tangible changes. And listening to those stories is just the first step.

In this enlightening conversation with Shawn Deane, we’ve explored the journey of an individual who inadvertently found himself in the world of workers’ compensation and emerged as a passionate advocate for human-centered approaches. The “It’s Settled” podcast is a testament to storytelling’s power in transforming industry perspectives and fostering empathy. As we navigate the complexities of workers’ compensation, Shawn’s insights remind us that behind every claim is a uniquely human story deserving of understanding, respect, and a human touch. Lastly, In Part 2 of the podcast, we will be reviewing some of those key stories and their impact.
